  • Your wife must have had a reason to apply for a rule 43 court order. Surely she cannot do that without a reason? 
  • How could your wife's expenses, ... exceed your income? Did she lie about her expenses? 
  • Your wife's affidavit stated that she was incapable of working. ... 
  • Why did you not submit the evidence in court during the hearing? 
  • What happened when you asked your lawyer to lodge an appeal? 
  • ... chances of an appeal is very slim? 
  • ... what other options differ from a normal trial? 
  • Are the courts allowed to ... grant orders that violates your basic human rights? 
  • Surely you must have had incompetent lawyers if they allowed ...

  • In your opinion, what is the problem with rule 43? 
  • What could be done to change rule 43 to correct the problem? 
  • So you think that husband's do not pay maintenance because ... 
  • So what can a person do if the order is ... 
  • Isn't going into hiding a bad idea because a order can be obtained for the arrest of the defendant? 
  • Maybe you should have accepted the court's decision and just paid the maintenance? 
  • Maybe you could have taken out a loan to pay for the maintenance? 
  • To say that ... is preposterous. Everybody knows that there are weights and counter-weights build into the law and ...? 
  • If this happened to you, then surely it must have been a once-off occurrence? 
  • To say that the court ... is ridiculous. Surely the law has been in place for many years and someone would have taken on the system if something like that happened? 
 

Questions from a fictitious wife on divorce in general 

  • Now coming back to me, my husband is not paying maintenance. How can I force him to do it? 
  • How can it be in my interest as a wife to ask for less maintenance?
  • Why do you say it is my responsibility to make sure that my husband can afford the maintenance?
  • My lawyer advises me to list all my expenses and inflate them a little because a court will only grant a portion of that and not the total amount? Should I do it? 
  • My lawyer advises me not to move out of the house. Should I stay or move? 
  • What does the court use as criteria when granting maintenance? 
  • My husband wants to settle. He says he cannot afford the house any longer. My lawyer says don't settle. What must I do? 
 

Here are some questions from a husband’s side. 

  • I have paid the rent and water and lights for my house which my wife is still living in as well as bought her groceries to the amount of R500 at the end of last month as well as advanced her R2000 on the maintenance which I have now deducted from the maintenance. My wife’s lawyer is now taking me to court and saying I may not deduct anything. Is he right?
